Subject of the Conditions

These Terms of Use (“Terms”) govern access to and use of the visitbaska.com website (the “Portal”), operated by Ernest Perić, OIB 87596637525, Drage Šćitara 34, Rijeka (“we”, “us”). The portal is an informative tourist guide for the town of Baška on the island of Krk, with accompanying affiliate monetization through partner platforms.

Acceptance of Terms

By accessing and using the Portal, you are deemed to have read, understood and accepted these Terms in their entirety. If you do not agree to any part of these Terms, please do not use the Portal.

Informative nature of content

All content published on the Portal — including but not limited to descriptions of accommodation, restaurants, activities, events, opening hours, prices and guides — serves solely as an informational guide for visitors to Baška and the surrounding area.

Although we make every effort to ensure that the information on the Portal is accurate and up-to-date, we do not guarantee the absolute accuracy, completeness or topicality of the published information. Opening hours, prices, capacity availability, booking conditions and other data dependent on third parties (catering facilities, renters, event and activity organizers) are subject to change without prior notice, and we have no control over these changes.

We recommend that users check the current information directly with the relevant service provider before making a final decision (booking, visit, purchase).

User responsibility

The User is solely responsible for the decisions he makes based on the information available on the Portal, including booking accommodation, purchasing excursions and activities, visiting restaurants or participating in events. The Portal does not directly mediate in the conclusion of contracts between users and third-party service providers (accommodation, catering facilities, activity organizers), except in the role of an affiliate referrer.

Affiliate Links and Independence

The portal contains affiliate links to partner platforms, including Stay22 (for accommodation) and GetYourGuide (for tours and activities). By clicking on such a link and possibly making a reservation, we can earn a commission from the partner, at no additional cost to the user.

We make editorial decisions about what content is displayed, how it is described and recommended, regardless of the amount of commission we might receive. However, the user should be aware that the existence of an affiliate relationship represents the commercial interest of the Portal, in accordance with the transparency statement stated in the Impressum.

We are not a party to the contract that the user concludes with a third party service provider (e.g. an accommodation contract with a Stay22 partner or an excursion contract with a GetYourGuide partner) and we are not responsible for the performance, quality or conditions of such services.

Copyright

All content of the Portal — texts, photographs, graphic elements, structure and design of the site — is protected by copyright.

It is not allowed to copy, distribute, publicly publish or otherwise use the content of the Portal without prior written permission, except to the extent permitted by applicable copyright regulations (e.g. short citation with acknowledgment of the source).

Ban automated content collection

It is prohibited to use automated tools, bots, scripts for automatic scraping, data mining or any other form of mass automated access to the content of the Portal without our prior written permission. Violation of this provision may result in access being blocked and, if necessary, legal action being taken.

Limitation of Liability

To the fullest extent permitted by applicable law, we are not responsible for:

direct, indirect, incidental or consequential damage resulting from the use or inability to use the Portal,
user decisions made on the basis of information published on the Portal,
the treatment, quality of services or content of third-party service providers to which the Portal refers,
temporary unavailability of the Portal due to technical maintenance, malfunction or external factors beyond our control.

Nothing in these Terms excludes liability that cannot be limited or excluded under the applicable regulations of the Republic of Croatia.

The Portal may contain links to third-party websites (partner platforms, tourist boards, government authorities and other sources). We are not responsible for the content, accuracy, availability, or privacy policies of these external sites. The inclusion of a link does not necessarily constitute a recommendation or endorsement of the content of that site in its entirety.

Changes to the Terms

We may amend these Terms from time to time in order to comply with changes in the operation of the Portal or applicable regulations. The amended Terms are effective upon posting on this page. Continued use of the Portal after the publication of changes is considered acceptance of the amended Terms and Conditions. We recommend checking this page periodically.

Applicable law

The law of the Republic of Croatia shall apply to these Terms and all relations arising from the use of the Portal.

Jurisdiction for disputes

The court in Rijeka shall be competent to resolve any disputes arising from the use of the Portal or the application of these Terms and Conditions, in accordance with the territorial jurisdiction prescribed by Croatian procedural law.
